South Africa’s Justice Minister, Mmamoloko Kubayi, has apologized to the United Nations and withdrawn an unauthorized legal summons that was improperly issued to UN Special Rapporteur on the Occupied Palestinian Territories, Francesca Albanese.
The incident occurred on Saturday evening when a sheriff attempted to serve Albanese with court papers reportedly initiated by Christian Friends of Israeli Communities and Christians for Israel USA. The action was taken without the required authorization from either the minister or the director general of the Department of Justice and Constitutional Development.
In a statement released Sunday, the ministry confirmed that the service violated Section 40(2) of South Africa’s legal procedures, which requires that any civil process request from a foreign entity must be routed through the director general and approved by the minister before execution.
“The attempt to serve Ms. Albanese did not comply with the required prescripts,” the ministry stated.
Kubayi, who is currently attending a UN conference in Vietnam, has ordered the immediate withdrawal of the summons and initiated an internal review to address the procedural breach. She extended formal apologies to Ms. Albanese, the Nelson Mandela Foundation, and the United Nations for the incident.
