Ghana’s Supreme Court Upholds Law Criminalising Anal Sex, Use of Sex Toys

The Supreme Court of Ghana has in a ruling upheld the law criminalizing anal sex and other unnatural forms of sex including the use of sex toys in Ghana.

According to the Court, anal sex, the use of vibrators, among others, remain offences under Section 104 (1) (b) of the Criminal Offences Act, 1960 (Act 29).

The seven-member Supreme Court panel headed by Justice Paul Baffoe-Bonnie, unanimously dismissed the writ challenging Section 104 (1) (b) of the Criminal Offences Act, 1960 (Act 29), an already existing law which criminalises anal sex and other forms of unnatural sex.

The panel made up of Justices Amadu, Gaewu, Adjei-Frimpong, Lovelace-Johnson, Kulendi, and Darko Asare, unanimously affirmed the constitutionality of the law.

The Supreme Court says the full reasoning behind its judgment would be made available at the court’s registry in 10 days.
